Terms of Service
Last Updated: May 18, 2026. These Terms govern your active monthly subscriptions, enterprise workspace parameters, and account parameters on the CAPITALESTATEPK ERP Platform.
1. Acceptance of Terms
Welcome to CAPITALESTATEPK. These Terms of Service ("Terms") constitute a legally binding agreement between your organization ("Client", "Subscriber", "you") and CAPITALESTATEPK ("we", "us", or "the Platform").
By registering for, paying, or actively utilizing our monthly subscription enterprise platform, you affirm that you possess the full corporate authority to enter into these Terms and agree to be bound by all structural policies listed herein.
2. Subscription Model & Seats
Our platform operates under a Software-as-a-Service (SaaS) monthly licensing arrangement:
User Seat Limits
Licenses are provisioned according to subscription plans (e.g., 3 seats for Starter, 15 seats for Professional, and unlimited allocations for Enterprise). Shared user logins are strictly prohibited and violate our security guidelines.
Add-on Licenses & Plot Limits
Subscribers can dynamically request add-on storage, additional user seats, or higher plot management quotas mid-cycle, billed pro-rata for the remaining days of that billing month.
3. Recurring Billing & Payment
To ensure uninterrupted operational visibility for your housing projects, we enforce clear billing protocols:
Monthly Recurring Charge
Subscription fees are automatically invoiced on the first calendar day of each subscription cycle and must be cleared within 5 business days.
Payment Channels
We support payments via direct credit card portal integration, localized 1Bill banking transfers, bank receipts, or standard company cheques.
4. Failures, Grace Periods & Refunds
Our billing engine tracks payment collections automatically and applies standardized recovery schedules to minimize platform access interruptions:
7-Day Grace Period
In the event of bank transfer failure or invoice delay, we provide a 7-day grace period where your team retains full, unhindered read/write workspace access.
Automated Account Suspension
If payment is not cleared within 10 days of the due date, your workspace is temporarily locked. Data is not destroyed, but CRUD database operations are blocked until the due invoice is cleared.
No Refund Policy for Mid-Month Cancellations
Subscribers can cancel their monthly plan at any time. However, to maintain the operational cost margins of cloud servers, we do not issue pro-rata refunds for the unused portions of that active billing month.
5. Permitted Use & Limitations
Access to CAPITALESTATEPK is granted subject to strict usage terms. You agree not to:
- Circumvent multi-tenant query controls or attempt to query databases of other organizations.
- Reverse engineer, disassemble, or extract proprietary database schemas or dashboard frameworks.
- Deploy automated web scraping engines against our secure property directories or live demo scripts.
- Transmit any malicious malware files or script codes into our secure document vaults.
6. Service Level (SLA) & Audits
We maintain a rigorous standard of platform uptime to ensure continuous operations for massive housing schemes:
Our Express backend servers and digital ledger modules are engineered for high-availability. We commit to a 99.9% operational uptime window, excluding scheduled maintenance scripts deployed between 2:00 AM and 5:00 AM Pakistan Standard Time (PKT).
7. Account Termination
Standard subscription cancellations are processed at the end of the current billing cycle. In the event of subscription termination:
- Your workspace database entries are made available for full CSV/JSON export for 30 days.
- Upon the expiration of the 30-day export window, your workspace data will be fully purged from our active databases and backup registers in accordance with our data policy.
8. Governing Law
These Terms and your active subscription licenses shall be governed by, interpreted, and enforced in accordance with the federal and provincial electronic transactions laws of the Islamic Republic of Pakistan.
Any disputes arising under these subscription terms shall be resolved exclusively through institutional arbitration in Lahore, Punjab, Pakistan.
